Claims relating to sales practice violations are generally brought as securities arbitration claims before the Financial Industry Regulatory Authority (“FINRA”). FINRA’s Arbitration Department is where investors, both retail and institutional, go to seek redress as a result of sales practice violations committed by their brokerage firm, including claims of over-concentration, misrepresentation and omission, unsuitable recommendations and failure to supervise.

A class action lawsuit, Beach and Kelly v. Citigroup, Inc., et al., Case No. 12-cv-07717, is pending against Citigroup, Inc. (NYSE:C) and Citigroup Alternative Investments, LLC on behalf of the Plaintiffs and other investors in the CSO Fund. Investors who purchased CSO and sustained substantial losses may also be able to recover their losses by filing an individual securities arbitration claim.

The class action alleges that “[misleading] representations and [material] omissions were made in the Fund’s Offering Memoranda (`OM’), Private Placement Memoranda (`PPM’) and Subscription Agreements on which investors relied (and were required to rely) and concerned the magnitude and nature of the Fund’s…risks, its investment and borrowing restrictions, its valuation policies, its risk management controls and its redemption policies.”
